The Booking Process

When someone is arrested, the first part of the process is that they are taken to jail for booking.

Because the booking process has several steps, it can take anywhere from one hour to several hours to complete, but it also depends on the size, staffing, and busyness of the jail at any given moment.

Things that typically occur doing during the booking process include:

  • a search for any weapons is performed
  • a mug shot is taken
  • the suspect will be fingerprinted
  • the suspect will be asked for a statement
  • there will be a background check
  • there will be a warrant check
  • the suspect’s information and criminal charges will be input to the computer system

The next step is for the defendant to be processed in and taken to a cell within the jail, and at this time they are typically given one phone call. Obtaining the Actual Bail Bond

The person who is going to be purchasing the bail bond will usually need anywhere between 20 minutes to a couple of hours to fill out all the  paperwork and complete the process of acquiring the bail bond. They will need to sign documents such as a bail indemnity agreement, a bail bond application, and a receipt.

It is at this time that a licensed bail bond agent will actually post the bail bond at the appropriate jail or detention facility where the defendant is being detained. It is only at this time that the defendant is released from jail. So, all in all, depending on the time needed to complete the booking process and acquire the bail bond. The entire process can’t take as little as an hour and a half to as much as many hours.

 

Showing Up for The Court Date

The final part of the process is that the bailee must show up in court. It is actually the bail bonds agency’s responsibility to ensure that the defendant for whom they posted bail appears in court on the day his or her trial is scheduled. If the defendant does not show up, then a bounty hunter is typically hired by the bail bond company to track down the defendant and bring them in.

The court typically gives the bail bond agency some time to locate the criminal defendant and bring them into court, but this can take time, so if you are purchasing a bond on someone else’s behalf, make sure to understand your responsibility before you agree to post bail
